Eric Scott, PG, DRMS <br />Wagner/Kauffman Pit #3 Technical Revision (TR) Request <br />' Boyd Lake Avenue Extension Revisions <br />July 15, 2010 <br />Page 2 of 3 <br />DCS Project 10-010 <br />There will also be a reservoir access and maintenance road constructed on the east side of <br />this proposed Boyd Lake Avenue embankment. This reservoir access and maintenance road <br />will be constructed to also serve as the new, revised west and northwest liner of the East <br />Reservoir. This reservoir access road and liner will be constructed outside the City right-of- <br />way. <br />The remnant corner of the East Reservoir cut off by the roadway will also be filled in and <br />reclaimed to serve as pasture land. The fill for this remnant area will meet key Division of <br />Reclamation, Mining and Safety (DRMS) requirements in regards to the depth and nature of <br />the fill. Specifically, the fill will be placed to a minimum of two feet (2') above groundwater <br />level, and the fill will be pervious enough to allow complete infiltration and/or evaporation of <br />all surface drainage within three (3) days of precipitation events. <br />The proposed topsoil and seed mixes for revegetation of these new pasture land areas will <br />be the same as previously proposed and used with consistent success on the site. There <br />have already been multiple areas of the Permit site released, including one just several <br />weeks ago, with the same topsoil and seed mix. <br />The final road construction is planned for some time in the future, and some areas of the <br />roadway embankment fill adjacent to this Permit are post-reclamation, and are noted as such <br />on the Exhibit F. However, the proposed roadway embankment construction required for this <br />TR is integral with the mining operation and related water storage reservoir construction. In <br />effect, the material from the reservoir excavation is necessary for the roadway embankment <br />fill. Consequently, even though the road use is post-reclamation, the subject construction will <br />have to take place now, while the pit is being actively mined and reclaimed. As a result, this <br />TR request is required to modify the proposed Reclamation Plan for this pit and Permit. <br />To restate and summarize some of our earlier, informal conversations, my understanding of <br />the determination that this request can be considered as a TR are based upon some key <br />facts of the proposed revision to the Permit, including: <br />• There is no expansion of the pit or Permit planned with this request; <br />• There is no time extension of the Permit or reclamation planned with this request; <br />• There is no significant change to the reclamation planned with this request, only a <br />change in the relative areas of water storage reservoir (which is reduced), and <br />pastureland (which is increased); <br />• There are no significant or notable impacts to area structures proposed with this <br />request, including utilities; <br />• There are no additional groundwater or water rights impacts anticipated with this <br />request; and <br />• There is no additional haul of pit material on public roads planned with this request. <br />A: 4220 Golf Vista Drive, Loveland, Co 80537 0 P: 303.929.3194 0 F. 303.600.8020 0 E. dangiroux@dcs-cm.com <br />@ Copyright 2010, DCS, Inc.
