Applegate <br />Group, inc. <br />May 18, 2010 <br />Mr. Eric Scott <br />Environmental Protection Specialist <br />Division of Reclamation, Mining; and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: Acreage Release Request; Jake Kauffman & Son, Inc.; <br />Wagner/Kauffman Pit #3; M-99-069 <br />Mr. Scott: <br />D <br />I%AY I 10 <br />Division Of <br />Min"n 8, Sae On, <br />The following information is being submitted on behalf of our client, Jake Kauffman & Song Inc. <br />The Wagner/Kauffinan Pit #3 mining operation (M-99-069) is located mainly in the Northwest 1/4 <br />of the Northwest'/4 of Section 21, Township 5 North, Range 68 West of the 6t" P.M. The site is <br />located in Larimer County approximately 1.5 miles east of Loveland, Colorado. <br />Phase I of the mining operation covers the east half of the permit area; with approximately 102 <br />total acres permitted. Mining in Phase I is essentially complete. Reclamation activities have <br />been concurrent with mining progression, and approximately 60 acres of Phase-I have previously <br />been released by the State following past acreage release requests. An additional 6.7 acres have <br />been backfilled and revegetated consistent with Exhibit E, Reclamation Plan, of the Reclamation <br />Permit Application. <br />Similar to the release you assisted us with a few years ago, Jake Kauffman & Son, Inc. is <br />requesting the additional release of the aforementioned 6.7 acres of the Phase I area. A reduction <br />in the permit financial warranty is NOT being requested. The affected area has been backfilled, <br />graded, and revegetated consistent with Exhibit E of the Reclamation Permit Application. All <br />backfilling and grading activities on the 6.7-acre portion of the site were done as mining <br />progressed. Final grading was finished in the summer of 2005 after mining operations were <br />completed and revegetation of the site was performed in the Fall of 2005. The attached revised <br />Reclamation Plan Map illustrates the additional acreage requested for release. The owner seeded <br />the affected area with pasture grasses consistent with the final land use, and the vegetative cover <br />is presently doing well.
