Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Requirement to Republish and Re- Notify, Hukill Gulch Millsite, File No. M- 2009 -076 <br />Dear Mr. McHale: <br />By letter dated November 24, 2009, the Division of Reclamation, Mining and Safety (DRMS) advised Venture <br />Resources, Inc. of the requirement for newspaper publication of a notice of the filing of permit application for <br />Hukill Gulch Millsite, File No. M- 2009 -076. The content of the newspaper publication is described in the <br />Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board ( CMLRB), 2 CCR 407 -1 <br />(Rule(s)). A template for the publication is provided to permit applicants in the Designated Mining Limited <br />Impact (110d) Operation Reclamation Permit Application Package. On December 3, 2009, the DRMS <br />received proof of Venture Resources publication in the Clear Creek Courant, which occurred on December 2, <br />2009. DRMS has determined that the publication is flawed, resulting in the requirement to republish the <br />notice. The notice that was published on December 2, 2009 states that the proposed future use of the land is "to <br />maintain its existing zoning designation (Residential/Mining M -1 zoning or Mining M -2 zoning, dependent on <br />the affected parcel) and resemble rangeland." The discussion of zoning is outside the scope of the notice required <br />by the rules, and is potentially confusing to persons reading the notice. The required notice must state the <br />proposed future use of the land, not what the land will resemble. <br />There are two other elements of the public notice to be addressed in the required republication. <br />1. The CMLRB has directed all permit applicants to include the following statements as the final paragraph <br />in public notices of the filing of applications: <br />Please note that under the provisions of C.R.S. 34 -32 -101 et seq Comments related to noise, truck <br />traffic, hours of operation, visual impacts, effects on property values and other social or economic <br />concerns are issues not subject to this Office's jurisdiction. These subjects, and similar ones, are <br />typically addressed by your local governments, rather than the Division of Reclamation, Mining, and <br />Safety or the Mined Land Reclamation Board. <br />Venture Resources must include the foregoing in the republished notice. <br />2. The notice that was published on December 2, 2009 states that the deadline for public comments is <br />December 16, 2009. The correct deadline date is ten calendar days after the date of publication or the <br />next regular business day, with day one of the ten day comment period being the day after the date of <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
