Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Conger Harvest Area, Permit M-1998-022, Conversion from 110c to 112c, CN-01, <br />Adequacy Review. <br />Dear Mr. Balaz, <br />The Division of Reclamation Mining and Safety has begun the final review of the <br />conversion application for the Conger Harvest Area. There is a timely objection to the <br />application which has been forwarded on to Tetra Tech. It appears that resolution of the <br />objection is probable but not definitive at this point. Until a formal withdrawal of the <br />objection is received staff must assume it stands and move forward with the objection <br />process. The noted objection withstanding, staff is moving forward with the finalization <br />of the review process. <br />The review of the application notes the conversion is to add in additional acreage on <br />Forest Service lands but maintain the previously approved low profile disturbance of one <br />acre or less. No new mining techniques or processes other than those previously <br />approved have been proposed within the conversion. Concurrent reclamation is still <br />noted as the main component of the new plan. The main change in reclamation is a <br />Forest Service requirement to monitor visual impacts from key observation points <br />(KOPs). Should visual impacts become readily noticed, Gallegos would be required to <br />stain fresh rock disturbances to blend in to surrounding area. While visual impacts are <br />not part of the Division's jurisdiction, mitigations tasks that might be required as part of <br />reclamation are. Based on this overview, staff has a few corrections and clarifications <br />that need to be addressed. Please respond to the following: <br />1) Please provide the affidavit of Publication required Per Rule 1.6.2(d). <br />2) Per Rule 6.2.1(2)(b) please provide signatures of the person(s) who prepared the maps for <br />the application. New maps are not necessary if signatures are provided at this office. <br />3) Per Rule 6.4.4(1), please provide a statement that no explosives will be used in the mining <br />operation. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
