Cattany <br />Hayden, CO 81639 Division Director <br /> Natural Resource Trustee <br />RE: Seneca II-W Mine (Permit No. C-1982-057) <br />Technical Revision No. 62 (TR-62) <br />Midterm Responses <br />Dear Mr. Karo: <br />The Division has reviewed the TR-62 adequacy responses and amended materials you <br />submitted under cover letter dated March 19, 2009, addressed to Susan Burgmaier of <br />DRMS. Adequacy Items 1 and 2 had been resolved prior to issuance of our Preliminary <br />Adequacy Review. Your submittal addressed remaining Adequacy Items 3 through 11, <br />and our review comments and requests on these items are set forth in the enclosure. <br />Note that in order to clarify certain issues pertaining to water rights (e.g. Fricderich <br />springs, permanent impoundments, and the Shop Well), the Division will be providing <br />further information to the Office of the State Engineer, and requesting their <br />consideration/advisement. Resolution of these water rights related concerns (3b, 6c, and <br />6d) will be pursued outside the context of TR-62. The Division will proceed with <br />issuance of the TR-62 proposed decision upon submittal of acceptable responses to items <br />not related to water rights (3a, 5, 6a, and 6e). <br />Please contac a if you have any questions. - <br />Sincerely, <br />Daniel T.
