Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety has begun the formal review of the above referenced <br />conversion from a 110(2) to a 112d(1) DMO. Please find enclosed a Preliminary Adequacy Review or PAR. It <br />is important to note that responses from Nuvemco to the issues noted below may generate additional questions <br />and clarification which will in turn need to be addressed. The review is being conducted by a team of <br />specialists from DRMS but all correspondence should be directed to me at the Grand Junction Field Office. - <br />Please note the following and respond where requested: <br />Public Notice Review: <br />Per Rule 1.6 it is noted the operator has provided proof of notices or filing as required under 1.6.2 and 1.6.5. <br />DRMS notes that the close of public comments was January 21, 2009 which was a holiday so comments would <br />have been accepted through the 22nd. The only comments received were from the Colorado Division of Wild <br />Life and the Colorado Office of Archeology and Historic Preservation. Both comments were forwarded to the <br />operator. Neither comment was considered an objection although the CDOW had suggestions and concerns. <br />DRMS requested dialog between CDOW and the operator with copies of correspondence being forwarded to <br />staff for notation in the permit file.
