Cattany <br />Division Director <br />Natural Resource Trustee <br />I-- i/' <br />Re: WRC Gravel Pit, Application No. M-2008-070, Completion of Application Review <br />and Final Reclamation Liability Estimate.-" <br />Dear Mr. Joy, <br />The Division of Reclamation Mining and Safety (DRMS) has completed the review of the above <br />referenced 112c application. Responses to adequacy and other issues received on January 12, <br />2009 appear to address the minimum requirements of the construction materials rules and <br />regulations. <br />Based on the final responses staff has calculated a Final Reclamation Liability Estimate. The <br />worse case scenario as pointed out in the application is the move from Phase 1 to 2a. This leaves <br />Phase 1 to reclaim, initial disturbances in Phase 2 and the Scale / Office Area to reclaim. Staff's <br />estimate is approximately 30% higher than that submitted in Exhibit L of the application. A <br />review notes that the exhibit did not include the scale house area, secondary seeding costs and <br />contract overhead. When these items are added to the exhibit estimate the numbers are fairly <br />close. <br />Please review the enclosed estimate. If there are any questions or errors please contact staff <br />immediately so that they may be addressed. If the estimate is acceptable please contact staff as <br />soon as possible as well. The acceptance of the estimate is the last issue prior to staff being able <br />to render a decision. The decision date is January 19th but due to the Martin Luther King Holiday <br />will actually be January 20, 2009.
