On behalf of Operator Pete Lien and Sons, Inc., please <br />accept this Notice that the Operator intends to cease mining operations at the <br />referenced site for more than 180 days. <br />This letter is prompted by an inspection by the Division dated 11/12/08. As an <br />initial matter, the Division's inspection record may be amended to note that the <br />Operator representative estimated the date that mining operations ceased as <br />1995, but the exact date full-scale commercial operations at the Weaver Quarry <br />ceased is not known. In any event, minor operations at the site have occurred <br />intermittently, including fairly recent activity, with a disturbance footprint noted in <br />the inspection record, to produce commercial samples of silica sand. <br />The Operator submits the following information as required for an initial Notice of <br />Temporary Cessation (Rule 1.13.5(2)): <br />(a) For the formal purposes of this Notice of Temporary Cessation, the date of <br />cessation is November 1, 2008. <br />(b) Mining operations at the Weaver Quarry will be placed in temporary <br />cessation due to market conditions, which have recently worsened with <br />the national economic recession and effects on the construction sector <br />locally and regionally. The market is not favorable to the profitable <br />recovery of mineral resources on the site at this time, but this is subject to <br />change. <br />(c) The Operator intends to.resume mining operations at the Weaver Quarry <br />when market conditions will justify the cost of operations and the <br />assumption of any new reclamation liabilities.
