Notice of Temporary Cessation <br />Weaver Quarry, M-1989-010 <br />29 December 2008 <br />Page 2 <br />Operator commits to informing the Division in advance of such <br />resumption. Should mining operations not recommence within five years, <br />by November 1, 2013, the Operator will file for an extension of Temporary <br />Cessation pursuant to Construction Materials Rule 1.13.8(1)(b). <br />(d) The Division noted in its 11/12/08 inspection report that vegetation is well <br />established throughout the Weaver Quarry site. In general, the M-1989- <br />010 site is presently compliant with relevant reclamation standards. <br />During the period of temporary cessation, new seed may be applied to the <br />site as appropriate to augment the current cover and will be applied to the <br />approximately 3 CY excavation area noted in the inspection report. The <br />haul road is in stable condition and will continue to be used for access to <br />the site; no further action is anticipated for the haul road during the <br />proposed period of temporary cessation, in accordance with Rule <br />3.1.10(8). <br />(e) The existing financial warranty is adequate to cover outstanding <br />reclamation liability. No problem has been noted by the Division or by the <br />Operator in keeping with its responsibilities. As noted above, reclamation <br />at the subject site of 77 acres has been largely achieved; the financial <br />warranty is adequate to cover the cost to prepare the soil surface, seed, <br />and mulch the remaining area of disturbance. <br />In addition to the information provided above, enclosed is a check for $144, the <br />fee for temporary cessation of a construction materials operation. <br />We are submitting this Notice with the goal of resolving the Division's inspection <br />notes by December 31, 2008.
