Cattany <br />Division Director <br />646 Main Street Natural Resource Trustee <br />Meeker, CO 81641 / <br />Re: WRC Gravel Pit, Application No. M-2008-070, Haul Road Construction Pre- <br />Operational Inspection Issue. <br />Dear Mr. Joy, <br />The Division of Reclamation Mining and Safety conducted a Pre-operational inspection <br />on December 10, 2008. During the inspection staff noted a section of the proposed haul <br />road needs some additional review. The concern is that widening the road identified on <br />the maps as Sections L112 through L118 on sheets 3 and 4 of Map C could cause <br />inadvertent negative impacts to the river. This impact could be caused by materials being <br />deposited in the river during construction of the road, maintenance activities during <br />mining or impacts during flooding. <br />During the site visit the applicant noted that the plan was to build up the road to a plain <br />where sufficient width can be garnered for two truck widths. First there is no mention of <br />road construction within the mine plan and must be addressed accordingly. Staff has <br />reservations as to how construction and compaction of a road will be accomplished <br />without materials being pushed into the river. Also, is the construction within the 100 <br />year flood plain? Such events would trigger Corp of Army Engineer concerns and issues. <br />Off site impacts from these potential events could be a violation of the reclamation permit <br />for which staff is sure the applicant wishes to avoid. Widening of the stretch of road also <br />appears impractical as the steep rock outcroppings prevent much latitude without creating <br />large highwalls for which stability issues must be addressed.
