Review -
Dear Mrs. Anne Best Johnson,
On November 26th, 2008 the Division received a Technical Revision for the above
referenced mine site. A decrease in the permit acreage is processed by the Division
through an Acreage Reduction/Release Request (pursuant to Rule 4.17 of the Mineral
Rules and Regulations of the Colorado Mined Land Reclamation Board for the Extraction
of Construction Materials), which is different than a Technical Revision.
The acreage release request must be in the form of a notice to the Office that the operator
would like to decrease the permit acreage. The operator must include the names, address
and phone numbers of all owners of record of the land they would like to release. The
written release notice must be sent by Certified Mail to the Division and it must be
separate from any other communication with the Office, in this case the Technical
Revision. Also, please include a map of the current approved permit boundary with the
areas that you would like to release delineated from the area that will remain in the
acreage.
In order for an area of the permit acreage to be released, the operator must have
completed all the reclamation to the specifications of the current approved reclamation
plan, for that area. Once the Office receives the acreage release request from the
operator, the site will be inspected within sixty days of receipt of the request. Once the
site has been inspected, the office will notify the operator of its decision within thirty
days.
The purpose of a Technical Revision is to make minor changes in the permit which will
only have minor effect on the approved Reclamation Plan. The Office believes there is a
