Responses follow the <br />same sequence as listed in your letter. The last section discusses potential future revisions <br />to the mining plan in regard to underground gas pipeline removal/ relocation. <br />1. Rule 1.6.5 (2) <br />Enclosed are a copy of proof of publication of the public notice that appeared <br />in the Durango Herald and copies of proof of service of this notice to <br />landowners within 200 feet of the affected land. <br />2. Rule 6.4.5 Exhibit E - Reclamation Plan <br />The intent of the applicant is to reclaim Phase 7 as soon as the current mining <br />in this phase is completed. The other phases within the original permit <br />boundary (Phases 1-6) will not be reclaimed until the cessation of mining. This <br />area is currently utilized for processing, stockpiling and staging. It is <br />anticipated that this area will be used as such throughout the life of the mine as <br />amended. <br />The initial phase to be opened for mining on the amended area is also to <br />remain un-reclaimed until the end of operations. This initial phase will serve <br />additional processing and stockpile purposes. The area of this phase is <br />approximately 10 acres. The remaining area in the amended affected land will <br />be reclaimed as each 10 acre section is depleted. <br />3. Rule 6.4.19 Exhibit S- Permanent Man-made Structures <br />Enclosed are copies of two separate notarized agreements: The first is in <br />regard to the existing underground gas pipelines owned by XTO. The second <br />agreement deals with the perimeter fencing owned by Byron and Kristin <br />Hilliard (amended area landowners).
