Cattany <br />RE: Compliance with Hard Rock, Metal, and Designated Mining Operations Rule 4.1(??Gral ision Director <br />Weber Pit No 2, Permit No. M-1995-056, Amendment <br />Dear Mr. Weber: <br />On May 17, 2007 the Division approved your application for an amendment to your permit #M-1995-056 <br />addressing the following: <br />Addition of 63.70 acres for a total of 114.64 acres. <br />The estimated liability amount of $92,689.00 exceeds the $70,753.00 performance bond currently held. The <br />Division did not receive the required warranties within the time period specified by Construction Materials <br />Rule 4.1(2). Therefore, the Division will schedule the application for reconsideration by the Mined Land <br />Reclamation Board. However, prior to the Division scheduling the item for Board consideration, the <br />Applicant, Wildcat Mining Corp., must complete the notice requirements of Rule 1.6, as indicated by Rule <br />4.1(2) and Section 24-4-105(1) and (2) of the Administrative Procedures Act. <br />Specifically, the Applicant must re-notice the application in a newspaper of general circulation in <br />accordance with Rule 1.6.5(1) and notify any new surface owners, easement owners and owners of <br />structures within the permit area and within 200 feet of the permit area that are different than what was <br />submitted in the original application. Pursuant to Rule 1.6.2(1)(c), copy of the application must be placed <br />with the County Clerk or Recorder for public review.
