Cattany <br />Brownfield Restoration Group, LLC Division Director <br />Corporate Square, 25 North Street Natural Resource Trustee <br />Canandaigua, NY 14424 <br /> <br />Re: Elam Construction, Inc., LLC, Gilsonite Pit, Permit No. M-2002-111,, Bond Calculation and <br />Approval of TR-02. <br />Dear Mr. Herman: <br />The Division of Reclamation, Mining and Safety has completed the review process for the above referenced <br />Technical Revision and determined that Elam Construction, Inc. has met the requirements for a 112c Technical <br />Revision under the Rules and Act. Staff is pleased to inform Elam Construction, Inc. that the technical revision is <br />approved. <br />The reclamation liability for the pre-phase is calculated to be $424.00 and rounded up to $500.00. Elam <br />Construction, Inc. must submit and have accepted the Financial Warranty for the technical revision to the permit <br />to become active. The construction of the gate may not occur until the warranties are in place and all other <br />necessary local, state and federal permits (if required) are approved and in place. Any questions regarding the <br />Financial Warranty should be directed to Elizabeth Taliaferro at 303-866-4084. <br />The division requires a 60 day notice prior to engaging in the next phase of the mine operation to allow adequate <br />time for reclamation bond recalculation. <br />The terms of the Technical Revision No. 2 approved by the Division are hereby incorporated into Permit No. M- <br />2002-111.
