Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: M-2008-006 SerFer Pit, -Second Adequacy Review Letter Response <br />Dear Mr. Hays: <br />The following, discussion and attachments are submitted on behalf of -our, client, Connell <br />Resources, Inc.., in response to the Second Adequacy Review comments prepared by the Division - <br />of Reclamation, Mining,- and Safety (DRMS) dated August 6th, 2008 for the SerFer Pit. The <br />information and discussion below address each comment as it was presented by the Division: <br />Rule 6.4.3. Exhibit C --Pre-Mining and Mining Plan Map(s) of Affected Lands <br />1. Exhibit C-2 - Mining plan map indicates a 1.00' setback (typ.) from top of riverbank and <br />ox-bow. Please commit to a minimum 100' setback from the riverbank and ox-bow and <br />remove the "(typ.)" notation from all areas of the map. <br />The applicant will maintain a minimum 100' setback from the top of the riverbank and <br />ox-bow. The "(typ) " notation has been removed from both Exhibits C-2 and F. Exhibits <br />C-2 and F are included as attachments to this letter. . <br />2. Please indicate and commit to a final reclaimed offset from the riverbank to the southern <br />edge of the reservoir. The Division recommends a minimum 400' offset. <br />The applicant will maintain a final reclaimed offset of 400' from the southern edge of.the <br />reservoir to the. riverbank. Exhibit F has been revised 'to show the 400' offset and is <br />included as an attachment to this. letter. <br />Rule 6.4.6 Exhibit F - Reclamation Plan Man <br />1 Exhibit F Reclamation Plan Map indicates a 100'. setback (typ.) from top of riverbank <br />and ox-bow.
