Mr. _Peter Hays <br />Re: SerFer Pit, Adequacy Letter Response <br />August 15, 2008 <br />Page 2 of 6 <br />The applicant will maintain a minimum 100' setback from the top of the riverbank and <br />'ox-bow. The "(typ.) " notation has been removed from both exhibits C-2 and F Exhibits <br />C-2 and F are included as attachments to this letter. <br />Rule 6.4.7 Exhibit G - Water Information <br />4. The applicant states that the entire mine site. lies within the 100-year flood plain of the <br />Cache la-Poudre River. In the event of a significant flood event (10- year flood or greater) <br />it is likely that the existing pit will be captured by the Cache la Poudre River. Wherever <br />mining will occur within 400 feet of the river channel, a flood analysis and flood control <br />plan must be evaluated and submitted. This would include pit side armoring, river site <br />armoring, inflow and outflow channels, or other. appropriate measure. Accordingly, the <br />Division requests that the applicant provide the flood elevations(s) to be expected under a <br />"worst case" flooding scenario and specific mitigation measures that will be implemented <br />to minimize the potential for any offsite impacts. <br />The applicant did not address the specific mitigation measure that will be implemented to <br />minimize the potential for any offsite.impacts including pit side armoring, river site <br />armoring, inflow and outflow channels, or other appropriate measure in the first adequacy. <br />response letter date d July 9, 2008. Please address this question or submit a reason for not <br />responding to the question. <br />A Floodplain Development Permit and Report was submitted to. the Division of <br />Reclamation Mining and Safety. The results of the study demonstrate that the mining <br />process will not negatively affect the floodplain. <br />Specific mitigation measures were not identified based on the results of the Floodplain <br />Development Permit and Report. Mining operations are a temporary condition and will <br />progress southward through the site. Mining operations on this site will be completed in <br />approximately four (4) years. As a result, mining operations within 400 feet of the river <br />are not expected to occur for a significant period of time and do not require specific <br />mitigation measures. However, in the unlikely event that flooding occurs in the short <br />amount of time that mining operations will occur within 400 feet of the river channel, <br />Connell Resources, Inc. will need to dewater the mining pit when the flooding condition <br />subsides in order to continue mining operations. <br />In the unlikely event of a flood resulting in damage to the 100' setback from the top of the <br />riverbank, Connell Resources, Inc. will commit to restoring the 100' setback area to pre- <br />flood conditions.
