LJ DEVELOPMENT, INC.
256 N. MERRILL DRIVE
PUEBLO WEST, CO 81007
PHONE: 719-240-9424 FAX: 719-583-0768
June 23, 2008
Tony Waldron
Southern District Supervisor
Division of Reclamation, Mining & Safety
1313 Sherman Street, Room 215
Denver, CO 80203
RE: Technical Revision #01 to 112c Permit No. M-2002-118
Velarde Pit - APC Southern Construction Co., LLC
Gentlemen:
0
CRE
JUN ? 4 ';,ii id
Division,„ , ._.._ aination,
Mining and Safety
As defined in Rule 1.1- Definitions, this technical revision application represents a
change which does not have more than a minor effect upon the Reclamation Plan for the
existing Regular 112c Permit for this operation.
The purpose of this technical revision is to remove an area of land from the Phase 3
affected land and add an area of equal acreage to the Phase 1 affected land. The reason
for change is due to the operator finding that the quality of the material is different from
what was previously thought. The material is of better quality than they had assumed
when it was originally permitted. Please refer to the attached revised mining plan map
for the details of the affected lands exchange.
We feel that the reclamation costs will not have to be adjusted since we are affecting the
same area as measured in acres and since the lands are identical in their unaffected state.
Therefore we believe that the required financial warranty amount will not need to be
increased nor decreased by this Technical Revision.
At present, Phase 1 of the mining operation is under progress, with a portion of the Phase
1 affected land having been disturbed. Phase 2 and Phase 3 affected lands are
undisturbed.
The proposed changes to the mining and reclamation plan are as follows:
1. Approximately 6.25 acres are to be removed from the western edge of the Phase 3
affected land. The revised acreage for the Phase 3 affected land is to he
approximately 40.75 acres.
2. An area of equal acreage, or 6.25 acres, will then be added to the eastern edge of
the Phase 1 affected land boundary. The revised acreage for the Phase 1 affected
land is to be change to 50.25 acres.
