Cattany <br />Division Director <br />Natural Resource Trustee <br />Please be advised that AM-03 may be deemed inadequate and may be denied on May 13, 2008 <br />unless the following adequacy review items can be addressed to the satisfaction of the Division <br />of Reclamation, Mining, and Safety (the Division or DRMS). The Division considers these <br />adequacy issues to be preliminary. Subsequent to receipt and review of the Applicant's <br />response to these preliminary issues, the Division may identify additional adequacy issues. <br />Herein, all references to the Act and Rules refer to the Colorado Mined Land Reclamation Act, <br />34-32-101 et sec.., C.R.S. (the Act or Hard Rock Act), and to the Mineral Rules and Regulations <br />of the Colorado Mined Land Reclamation Board for Hard Rock, Metal and Designated Mining <br />Operations (the Rules). Copy of the current Act and Rules are available on the Division's web <br />site at www.mining.state.co.us. <br />Adequacy Issues Specific to Rules 3.1.5, 3.1.6 and 3.1.7 <br />Discussions provided in Appendix A and B of AM-03 indicate that the quality of the West Pit <br />ground water has chemically equilibrated at or better than pre-mining ground water quality. <br />Appendix A contains a Technical Memo #212100 from Telesto, dated January 3, 2004 and <br />Appendix B contains a document generated by the Division, dated September 14, 2005., Both <br />documents acknowledge that the ground water chemistry conditions are dependent upon <br />maintenance of the ground water elevation within the backfilled West Pit. Apparently, minor <br />fluctuations in the elevation of the West Pit ground water can result in degraded water quality <br />with elevated concentrations of contaminants than currently exist: Current permit conditions <br />require the Operator to process the water pumped from the West Pit through a water treatment <br />plant prior to release in accordance with the Colorado Discharge Permit System (CDPS) permit. <br />Current permit conditions demonstrate compliance with Rule 3.1..6. Pursuant to Rule 3.1.6, <br />disturbances to the prevailing hydrologic balance of the affected land and of the surrounding <br />area and to the quantity or quality of water in surface and ground water systems both during and <br />after the mining operation and during reclamation shall be minimized. <br />Office of Office of <br />Mined Land Reclamation Denver Grand Junction Durango Active and Inactive Mines <br />
