Dear Mr. Lyle:
Thank you for providing copy of the first and second publication of the public notice for AM-03
required under Rule 1.6.2(1)(d). The public notice indicates that publication is occurring in the
Valley Courier on January 12, 19, 26 and February 2, 2008. The public notice states that the
public comment period will close at 4:00 p.m. on March 1, 2008, approximately 28 days after the
last date of publication. Therefore, the Applicant has voluntarily extended the public comment
period eight days beyond the minimum requirements of Rule 1.7.1(2)(a). Pursuant to Rule
1.6.5(2), please forward to this office proof of publication no later than February 15, 2008.
As of the date of this letter the Division has received one objection from the Costilla Soil
Conservation District; one comment from the State Historic Preservation Officer with the Office
of Archaeology and Historic Preservation; and conditions for approval from the Office of the
State Engineer, Division of Water Resources, regarding AM-03. Copy of the objection from the
Costilla Soil. Conservation District, dated January 15, 2008 and received on January 17, 2008,
was previously faxed to you on January 25, 2008. Copy of the three correspondences is
enclosed for your records.
Please inform the Division how the Applicant will address the jurisdictional issues raised by the
objecting party and the conditions for approval from the Division of Water Resources.
