RECEIVED <br />April 30, 2008 <br />MAY U 2 2008 <br />Fremont County Board of Commissioners <br />Fremont County Planning and Zoning Division of Reclamation, <br />615 Macon Avenue, Room 105 Mining and Safety <br />Canon City, CO 81212 <br />Re: March 11, 2008 Hearing Request: Extension of Conditional Use Permit <br />(CUP) 98-3 Energy Fuels Coal, Inc. (Southfield Mine) <br />To All Concerned: <br />I am the daughter and have power of attorney (POA) (see Attachment A) <br />for Irene C. Coulter who is 2/3 property owner of the Southfield Mine. This <br />letter is a complaint against the process regarding notice for the <br />conditional use permit (CUP) extension submitted by Energy Fuels Coal <br />Inc. Upon your review of this letter we are also requesting a re-hearing <br />regarding this matter. Following is an outline of our grievances: <br />- Notification Letter from Energy Fuels (see Attachment 6) <br />I had a telephone conversation with George Patterson, <br />General Mine Manager for Energy Fuels, on March 12, <br />2008 regarding why we had not received his letter <br />notifying us of Energy Fuels request for an extension. <br />He stated that he got our address from the Fremont <br />County tax assessor's Internet site. I receive all of the <br />tax notices for our Fremont County property at my <br />address; 1041 Field Street, Lakewood, Co 80215 and it <br />is the address listed on the tax assessor's web site. <br />The address where the Energy Fuels letter was sent <br />has not been used for over two years and is not listed <br />on the web site. A change of address letter was sent by <br />me to Energy Fuels on November 30, 2005 giving my <br />address for all correspondence. Idid not receive the <br />notification letter until the evening of Monday, March <br />10, 2008 which was the day prior to the proposed <br />hearing. Because of this inefficiency we were not <br />granted due notice for the hearing. <br />Upon receipt of the letter we found nothing within its <br />content which delineates the specific reasons for <br />requesting the extension. There has not been sufficient <br />data communicated to us which substantiates the <br />necessity for the extension period.
