Fuels we have insufficient information of the facts for <br />our rebuttal. Contrarily, there has not been any <br />correspondence or communication by Energy Fuels or <br />the State of Colorado Division of Mining, Reclamation <br />and Safety over the course of the past 4'/2 years of <br />reclamation which give any indication that the <br />reclamation efforts were not going according to <br />schedule or plan. <br />We are requesting a new hearing when all of the facts <br />supporting the extension request have been submitted <br />by Energy Fuels and the State of Colorado Division of <br />Mining, Reclamation and Safety. <br />- March 11, 2008 Hearin <br />The minutes from this meeting did not clarify in any <br />manner our aforementioned concerns. Contrary to the <br />extension request Mr. Patterson stated that "the <br />reclamation process is proceeding well". Additionally <br />Commissioner Lasha complimented Mr. Patterson on <br />the reclamation that has been done. There have not <br />been any reports from the Colorado Mined Land <br />Reclamation Board that give any indication for the <br />necessity of an extension of the Conditional Use Permit. <br />Also noted in the minutes of the meeting was Bill <br />Giordano's admission that there was an a-mail received <br />by his office from Linda DeFillippe Saunders requesting <br />that the hearing be postponed. Ms. Saunders and her <br />sister Tena DeFillippe Gallagher own the remaining 1/3 <br />of the Southfield mine. The consensus of the <br />Commissioners was to continue the hearing. The <br />hearing was continued without the Board's knowledge <br />of the facts regarding the notification of the parties. <br />The issue of the lease (see Attachment C) between <br />Energy Fuels and we, the owners of the Southfield mine <br />was also discussed. The lease states the following: <br />o TERM of the LEASE Page 2 # 2. "The term <br />of this lease shall be strictly limited to a <br />period of two (2) years from and after <br />March 20, 2000, terminating on March 20, <br />2002.
