SHELTO N, Dlreetor <br />March 13, 1985 <br />Mr. .Tommy Raye <br />Western Fuels-Utah, Inc. <br />405 Urban Street, Suite 305 <br />Lakewood, Colorado 80228 <br />Re: Professional Certification Documents <br />Dear Mr. Raye: <br />This letter is a follow-up to our telephone conversation of a couple of weeks <br />ago regarding clarification of the Division's February 4, 1985 comments on <br />various professional certification documents submitted to the Division during <br />the latter part of 1984 and the early part of January, 1985. <br />The following comments outline specific items to be included in: A. Haul <br />Road Certifications; and, B. Coal Waste Bank Quarterly Inspection Reports. <br />A. Haul Road Certifications <br />1. A statement of the professional qualifications of the certifying <br />professional. <br />2. A citation of the Rule requiring the certification (4.03.1(1)(d)). <br />3. A specific description of the subject of the certification. <br />4. A statement of the actions taken in preparing the certification, <br />including such things as inspections performed (date, time, weather & <br />methods), laboratory or field testing performed, plan or permit <br />documents reviewed, and consultation with other professionals. <br />5. A statement of pertinent professional observations and conclusions <br />" made during the completion of the certification. <br />6. A statement of compliance with the prudent state-of-the-art. <br />1. A statement of compliance with the approved mine plan and permit, <br />specifically referencing appropriate portions of the permit documents <br />(plans, maps, and text). <br />8. A seal of facsimile for registered Professional Engineers and <br />Professional Land surveyors, presenting the professional's license <br />number. (Certifications are only legal when performed by <br />professionals properly licensed within the State of Colorado.) <br />9. An original signature of the certifying professional, on all copies <br />submitted to the Division or retained at the mine site for <br />examination by inspection personnel or the public. <br />,Based on a review of Deserado's January 14, 1985 letter from Mike Weigand <br />regarding haul road certification, the following items from the above list <br />appear to be missing and should be added in order to arrive at an acceptable <br />certification: <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
