Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed Kerr Coal Company's 2003 Annual Hydrology Report (AHR) <br />for the Marr Mine. This letter presents the Division's comments and recommendations <br />regarding the 2003 AHR. The report presentation is not acceptable as submitted and the <br />frequency of data collection is not in compliance with the approved monitoring plan <br />contained in the permit document. Review comments are provided as follows. <br />a) The 2003 water year extends from October 2002 through September 2003. <br />Field parameter data were not provided in Appendix A 2003 Field Data for any of <br />the required monthly or quarterly October 2002 samples for surface discharge <br />points, alluvial wells, and the spoil well. Likewise, water level measurements <br />were not reported for October 2002 for the alluvial wells and the spoil well. <br />b) October 2002 water quality data are not presented for Wells AO-2A, AP-1, <br />AP-2, and SP-O1. <br />c) It appears that no sample was collected during April 2003 for Wells AO-2A <br />and SP-Ol. <br />d) Samples were collected in May 2003 instead of April at wells AP-1 and AP-2 <br />due to the frozen condition of the wells. <br />Please provide an explanation why these data, items la) through lc) were not <br />collected as required by the approved monitoring plan. If these data are available <br />provide them in revised report pages. <br />Appendix B is duplicated for mine area alluvial water quality and for mine area <br />spoil water quality.
