BANTA, Dlnetor <br />September 18, 1989 <br />Arts Fertilizer Company <br />3900 E 56th Ave <br />e t 0022 <br />Re: File M-80-205, A s <br />Gen <br />Fertilizer Co Mine, Annual Fees and Reports <br />Pursuant to Senate Bill No. 162 (Revisions to the Mined Land Reclamation Act), <br />signed on May 6, 1988, to become effective July 1; 1988, the provision which <br />allowed the exemption of payment of annual ee~~on temporary cessation <br />status for 110 mining permits was deleted. Subsequent to the passage of the <br />above legislation the Mined Land Reclamation Board amended the Rules and <br />Regulations incorporating this change as follows: <br />34-32-116 Duties of Operators ='Annual Report and Fee <br />All operators having a two acre limited impact permit in accordance with <br />34-32-110 (1) (permits of less than 2 acres, extracts less than seventy <br />thousand (70,000) tons of mineral, overburden, or a combination thereof per <br />calendar year, does not extract sand, gravel, or quarry aggregate, is not <br />located in or adjacent to a stream channel, and does not process minerals by <br />acid or toxic-forming means) shall submit an annual fee of twenty five dollars <br />(E25.00) and a map or sketch describing the acreage affected to date and the <br />acreage reclaimed to date. <br />All operators having a mining permit in accordance with 34-32-110 (2) (permits <br />of two acres but less than ten acres, which mining operations will result in <br />the extraction of less than seventy thousand tons of mineral or overburden per <br />calendar year) shall submit an annual fee of fifty dollars (E50.00) and a <br />report and map showing the extent of current disturbances to affected land, <br />reclamation accomplished to date and during the preceding year, new <br />disturbances that are anticipated to occur during the upcoming year, and <br />reclamation that will be performed during the upcoming year. If no new <br />disturbances or reclamation have occurred during the previous year and no <br />changes to the pevious year's map are necessary, then no new maD is required, <br />provided that the operator shall state this in the annual report, <br />\ 215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
