The decision date for this permit has been extended to June 1, 2006 due to objections received. In <br />order to meet this deadline, a hearing to determine whether the application shall be approved or denied by the <br />Mined Land Reclamation Board (Board) must be scheduled for the May 10, 2006 meeting of the Board. The <br />Division of Minerals and Geology (Division) is required to make a recommendation for approval, approval with <br />conditions, or denial by no later than April 20, 2006 in order to allow adequate time for notifications and <br />scheduling of apre-hearing conference to address the application objections. Therefore, your response to the <br />following adequacy review concerns should be submitted to the Division as soon as possible. <br />1. Rule 6.2.1(2) requires that maps be prepared and signed by a registered land surveyor, professional engineer, <br />or other qualified person. The maps submitted to the Division were not signed. Please submit the proper, <br />signed maps to the Division. <br />Rule 6.4.4 Exhibit D- Minine Plan <br />2. Section (a) of the Mining Plan requires the Operator/Applicant to supply a description of the method(s) of <br />mining to be employed in each stage of the operation as related to any surface disturbance on affected lands. <br />The applicant states that this operation will excavate down to approximately 10 feet and will not expose <br />groundwater. The Applicant indicates that the Operator will instal] three monitoring wells to determine the <br />depth to water and to possibly monitor the groundwater level if groundwater is shallower than 15 feet, to <br />confirm that the proposed mining plan will not expose groundwater. Please include the proposed monitoring <br />well locations on the mining plan map. <br />3. Also related to this section, the Applicant proposes the installation of a process area at the site to include a <br />screener, crusher, and batch plant. None of these structures are proposed to remain in the reclamation plan, <br />Please indicate the nature of these structures -composition, size, mobility - so that this information can be <br />used in calculating the financial warranty £or the site. <br />4. Section (a) (d) of the Mining Plan requires the Operator/Applicant to describe the size of area(s) to be worked <br />at any one time.
