Rule 6.4.7 Exhibit G -Water Information <br />5. Rule 3.1.6 (1) states that disturbances to the prevailing hydrologic balance of the affected land and of the <br />surrounding area and to the quantity and quality of water in surface and groundwater systems both during and <br />after the mining operation and during reclamation shall be minimized. Please describe how fuel stored in fuel <br />tanks will be contained at the site in the event of a fuel leak or spill. The applicant states that a processing <br />plant and concrete plant will be located on a portion of site. Please describe how the facilities will contain <br />process water to prevent it from infiltrating into the groundwater table. <br />6. The Applicant has addressed issues related to Rule 3.1.6 (1) with regard to the proposed site's orientation relative <br />to the floodplain of the Middle Fork of the South Platte River by supplying the Division with copies of FEMA <br />maps for the two sections in which the site lies. The map for section 11 appears to coincide with the site, but the <br />map far section 14 does not. Features in section 11 on the section 14 map do not appear in the section 11 map - <br />specifically the presence of a zone A floodplain for three playa lakes, and the location of Hwy 9 on the section 14 <br />map does not coincide with that in the section 11 map or with the actual location of Hwy 9. Please clarify this <br />discrepancy. <br />Rule 6.4.12 Exhibit N -Source of Legal Rieht to Enter <br />This Rule requires the Operator/Applicant to provide the source of the Operator/Applicant's legal right to <br />enter and initiate a mining operation on the affected land. The Applicant states that the Operator published <br />notice of intent to claim minerals on the subject property. Please supply the Division with a copy of this <br />notice. <br />Because objections were filed for this Permit, this matter must be set far a hearing before the Board. The <br />tentative date for the hearing is May 10, 2006. The Division will need to make a recommendation by April 20, <br />2006. Please be advised that the Allen Drilling and Excavating Co., Inc. 112(c) Permit Application may be <br />deemed inadequate, and the application may be denied on May 10, 2006 unless the above mentioned adequacy <br />review items are addressed to the satisfaction of the Division. Responses to these adequacy concerns must be <br />received by the Division to allow adequate time for review prior to the recommendation date, or no later than <br />April 18, 2006. If you feel more time is needed to complete your reply, the Division can grant an extension to the <br />recommendation date, and therefore the decision date. This will be done upon receipt of a written waiver of your <br />right to a decision by June 1, 2006 and request for additional time. This must be received no later than May 9, <br />2006.
