• Rule 2.07.1 Scone
This Rule establishes the requirements for:
(I) Public participation in the permit process;

(2) The review of permit applications and decisions on these applications by the Division and
Board; and
(3) Approval or disapproval of permits to conduct surface coal minine and reclamation operations and
for the terms and conditions of permits issued.
RESPONSE
Except for subsections 2.07.3(2), 2.07.3(4) and 2.07.6(2)(d)(iv)(A), Rule 2.07 defines administrative
responsibilities and CNII.RD policy. Therefore, the only Rules requiring responses are 2.07.3(2), 2.07.3(4) and
2.07.6(2)(d)(iv)(A), as provided below.
2.07.2 Objectives.
The objectives of 2A7 arc to:
(1) Provide for broad and effective public participation in the review of applications and the issuance
or denial of permits:
(2) Ensure prompt and effective review ofeach permit application by the Division or Board; and
(3) Provide [lie minimum requirements for the terms and conditions of permits issued and the criteria
for approval or denial of a permit.
Rule 2.07.3 Government Aeency and Public Comments on Permit Applications
(I) Upon submission of an application for permit or revision or renewal thereof. the Division shall,
widtin 10 days of receipt of said application, review the submission and determine if it is complete. [f the
application is complete, the applicant shall be duly notified and fhe application shall be considered filed for
purposes of the Act. If the application is incomplete, notice [o that effect shall be mailed to the applicant within
said 10-day period, and the applicant shall be >;iven the opporttmiq- to amend, review. or otherwise make said
application complete.
(~ At the time of submission of an application for a permit. or for rene~eal or revision of an eeistin~
permit, dre applicant shall submit to the Division the proposed notice of publication of the ownership, precise
location, and boundaries of the land to be affected by the proposed surface coal minim! operation Upon
notification to the applicant that the application for permit or the application for a permit revision or renewal is
complete, the applicant shall place the notice of ownership, precise location, and boundaries of land to be affected
by die proposed surface coal minintt operation in a local ncus~apcr of ~,encral circulation in the locality of said
operation. This publication shall be published at least once a week for four consecutive weeks l'he publication
