Dear Mr. Hart,
Listed below aze the additional Division's comments on the Camenish Borrow 111 Special
Operations permit application. The decision date for your application is scheduled for December
13, 2006. Therefore, I would appreciate a response to these comments from you as soon as possible.
Please provide a table of the significant made structures and the setbacks the Applicants is
corrunitting to. Please be specific what the setback is relative to (for example; from the top or
bottom of the excavation). There was some confusion on setbacks with the different documents and
responses. For example the most recent map has a SO foot buffer for the gas pipeline (2S feet on
either side?), but the Applicant has committed to 40 foot setback.
The commitment to mine at a 3:1 slope would appear to run contrary to the proposed design for the
compact clay liner that suggests mining at a 1: 1 or steeper angle and then creating a 3:1 slope with
the installation of the compact clay liner. Please clarify how this might work, and adjust either the
mine slopes and associated setbacks or adjust the design drawing and criteria for the compact clay
liner to address this apparent contradiction.
Please provide evidence of the Applicant's attempts to come to agreement with the persons having
an interest in the man made structures (6.3.12(a)).
It is the Division's understanding that even with the approval of the SEO on seepage from the
compact clay liner, that if any water is exposed that Applicant will have to provide augmentation for
that water. This is different that what is stated in the Applicant's December 11 2006 letter. If the
Applicant does need to provide permanent augmentation water for this site, the Division will
withhold permit release until the augmentation plan is approved.
