I have reviewed the two applications <br />separately and have presented my comments first for Pit No. 1 and then <br />for Pit No. 2. The comments for each pit are organized on an <br />exhibit-by-exhibit basis. Any exhibit or part thereof not mentioned is <br />considered adequate at this time. Please plan to respond to this letter <br />gas soon as possible. The adequacy concerns raised in this letter must be <br />answered before these applications can be ready for presentation to the <br />Mined Land Reclamation Board. <br />Before the Board can consider either of these two applications, our <br />Division must receive proof of the four sequential weeks of publication <br />in a newspaper of local circulation for both pits. This proof should <br />take the form of a publisher's affidavit or copy thereof. The four weeks <br />of.publication are, of course, to be followed by a 20-day public comment <br />period which must be completed before the Board meeting. Please provide <br />this proof at your earliest convenience. <br />We must also receive proof that all immediately adjacent landowners of <br />both pits have been sent a copy of the first publication by certified <br />mail. This proof should take the form of the green certified mail return <br />receipts or copies thereof. These should also be sent to us as soon as <br />possible since these notifications must have occurred before the Board <br />considers the permit. <br />Pit No. 1 <br />Exhibit A <br /> <br />Presumably, the legal description given of the S 1/2 I1W 1/4 of Section 12 <br />means that the operation lies in both the SE 1/4 NW 1/4 and the SW 1/4 NW <br />1/4 of Section 12. Please clarify this matter.
