Box 857 <br />Pueblo, Colorado 81002 <br />Re: Oakleaf Pit <br />File No. M-84-089 <br />Dear Mr. Cramb: <br />I have completed my adequacy review of the 110 permit application for the <br />Oakleaf pit. I have several questions and comments concerning this <br />application that I have organized on an exhibit-by-exhibit basis below. Any <br />exhibit or part thereof not mentioned is considered adequate now. Please <br />respond to this letter by June 25, 1984 such that I will have time to review <br />your responses (and comment, as necessary) before the scheduled <br />June 27-28, 1984 meeting of the Mined Land Reclamation Board. If we can <br />resolve the various areas of concern this matter can be considered as a "no <br />problem" matter, and you will not need to be present at the meeting. <br />Before the Board can consider this application, the proof of the two <br />aQN~sequential weeks of publication (publisher's affidavit or a copy thereof) and <br />the proof of notification of all imnendiately adjacent landowners (certified <br />I mail white or green receipts, or copies thereof) must be submitted to our <br />.I Division. Please submit these items as soon as possible. <br />Exhibit B <br />1. Our Division staff concurs with the Division of Wildlife in their <br />J statement that a 100' undisturbed setback from the Arkansas River be <br />left to insure the integrity of the pit/pond area and to protect <br />valuable riparian habitat. Please commit to such an undisturbed buffer <br />zone or provide further justification for a narrower setback. <br />2. If overburden is to be used to add sinuosity to the lake in reclamation, <br />stockpiling topsoil on top of overburden piles will not be practical. I <br />2 suggest instead, that the topsoil be stockpiled away from overburden <br />such that it can be used as needed. In this regard, I suggest that <br />• Valco commit to using all overburden to create irregular shorelines in <br />final reclamation. <br />3~ The present application does not anticipate processing on site.
