If it <br />v/ will need extensive reconstruction, it may need to be considered as part <br />of the affected land and reclaimed as such. Please clarify this matter. <br />Exhibit D <br />J Wildlife - Please reference my comments above concerning a 100' <br />undisturbed setback from the Arkansas River, as recommended by the <br />Division of Wildlife and our staff. <br />2~ Water Resources - I suggest that you contact the Colorado Division of <br />Water Resources concerning the need for water rights in connection with <br />the creation of a lake in final reclamation. <br />3. Vegetation - A CO-ECS-2 form from the Soil Conservation Service is <br />needed to provide the required species composition and cover estimates <br />5 ~ S~ for the vegetation on the proposed permit area before the Board can <br />~ ~~yi~~yapprove this application. Please contact the S.C.S. in this regard. <br />Exhibit E <br />1. Reference Rule 6.1(f) concerning the grading requirements for <br />J shorelines. Slopes should be 3:1 from 5' above to 10' below the <br />expected waterline and Z:1 otherwise (rather than the angle of repose <br />which is usually closer to 1 1/2:1). Please either commit to sloping of <br />2:1 in the appropriate region, or justify why the Board should grant a <br />variance in this matter. <br />2. I suggest that the overburden be used to add shoreline irregularities in <br />final reclamation rather than being left as flood control berming in <br />final reclamation (as I mentioned under Exhibit B, question 2). Such <br />irregularities contribute to wildlife usage (as your final land use <br />contemplates). Please clarify your position in this regard. <br />3. An operator should commit to regrading, topsoiling and planting of all <br />/ areas needing reclamation, including the north and east pit boundaries <br />_vf/ (lake shores), since the limited impact permit for which you are <br />applying must have an approved reclamation plan for all parts of the <br />permit area. If the permit is later converted to a 112 permit, the <br />reclamation plan can be modified at that time. <br />4. Given the final land use, the replacement of trees and shrubs found on <br /> <br />y~ site would seem to be indicated (such as, rabbitbrush, tamarisk, <br />5 L• cottonwood and Russian olive, as found by the S.C.S.).
