Walther <br />Executive D~reclor <br />Michael B Long <br />Division Dnenor <br />Listed below are remaining adequacy review concerns on the above-captioned Regular 112 Application <br />that will need to be resolved prior to the June ] 1, 2001decision date. Therefore, I would appreciate a <br />response from you on or before June 1 1, 2001. Please be advised that your application may be deemed <br />inadequate and may be denied on June 1 1, 2001 unless the following adequacy review items are addressed <br />to the satisfaction of the Division. <br />6.4.4 EXHIBIT D - Minin¢ Plan <br />1. The mine plan map shows that all of Areas 1 & 2 and part of Area 6 occur within the 100-year <br />floodplain of St. Vrain Creek. Further, all planned areas of excavation, with the exception of Area 4, will <br />have pit slopes and areas that will be within 400 feet of the channel of St. Vrain Creek. Therefore, the <br />Division will require that no mining be done within 400 feet of the channel of St. Vrain Creek until the <br />applicandoperator has provided an approvable Flood ControVMitigation Plan for the Fredstrom Resource. <br />Such Flood ControUMitigation Plan will need to be submitted as a modification to the permit and will need <br />to ensure that 1) channel areas, disturbed pit slopes, and on-site structures (where mining will occur within <br />400 feet of the channel) will be stabilized adequately for anticipated flood flows, and Z) Floodwaters will <br />be discharged in a controlled manner from any areas of excavation that are within 400 feet of the channel <br />of St. Vrain Creek. (The Division prefers that the applicant commit to the above measures and incorporate <br />in[o the permit application). Please respond. <br />6.4.8 EXHBIT H -Wildlife Information <br />2. The Division appreciates your cooperation in providing any written commen[s from the Division of <br />Wildlife (DOW) in order that any DOW concerns may be considered and resolved prior to the June 11, <br />2001 decision date. <br />
