<br />6.4.12 EXHIBIT L -Reclamation Cost <br />3. The itemized costs listed in Exhibit L will need to be revised in accordance with the applicant's <br />commitment to be bonded for a maximum disturbance of Phases 5 and 6, and the plant site area. The <br />applicant has clarified that the maximum volume of overburden to be stockpiled at any one time is 150,000 <br />cubic yards. Therefore, Exhibit L should include an itemized cost for backfilling this volume into the pit <br />and grading to finish contours. Exhibit L should also include an itemized cost for mobilization and <br />demobilization of reclamation equipment. Please address. <br />4. The applicant has submitted a request to submit a limited financial warranty of $1,000 until they are <br />ready [o begin operations. The Division is willing to grant this request to the applicant subject to the <br />following criteria: 1) an adequate reclamation cost estimate for the maximum disturbance exected will be <br />determined on or before the June 11, 2001 decision date, 2) the applicant will need to submit a properly <br />executed financial warranty of at least $1,000 within 365 days of permit approval, 3) the applicant/operator <br />will submit the required annual fees and reports on or before the anniversary date (permit issuance date) <br />each year, and 4) the operator will submit a written notice to the Division of their intent to begin mining <br />and will submit a properly executed financial warranty in the full amount required at least 60 days prior to <br />iniation of disturbance. <br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />5. The mining limits depicted on Exhibit C, Mining Plan Map may be approved. However, since the <br />mining limits do not coincide with the proposed permit boundary, it is important for [he applicant [o be <br />aware that the mining limits depicted on the map are not considered by the Division to be generalized or <br />flexible. Rather, these mining limits and the setbacks from structures stated in the application will be <br />enforceable components of the reclamation permit. As such, the Division recommends that the mining <br />limits be marked in the field prior to commencement of excavation. Please comment. <br />Once again, I will look forward to your response on or before June 11, 2001. Rule 1.8.1 states that <br />changes and additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
