As required by rule 1.6.5(2), please find attached the proof of pub{ication from the Herald <br />Democrat (Leadville newpaper). <br />2. We have received the written comment from the Colorado Division of Water Resources. <br />We do not believe that a stone water discharge permit is required for this project. We will <br />get confirmation from the Division of water resources and if a discharge permit is required <br />we will obtain a permit from the Department of Public Health and Ernironment, Water <br />Quality Control Division. Also in the Division of Water Resource letter dated January 4, <br />1999 it was noted that no ground water will be exposed. ACA does not intend to expose <br />any ground water and any water use will be by a substitute supply plan initiated through the <br />Division of Water Resources. <br />3. The mining to the Templeton Ditch will not be mined vertical to the 15 foot and 3 foot lines <br />denoted on the plan. ACA will maintain a 4;1 slope when approaching the ditch so no <br />bacldill is required around the ditch. For ease of reclamation ACA will not mine vertically to <br />arty structure of boundary so backfilling will not be done to any finished slope. Other than <br />the backfiliing of top soil for final reclamation. As the fetter of agreement with the users of <br />the Templeton ditch states ACA will repair /reconstruct any damage that may occur to the <br />ditch due to ACA's operation. <br />4. As stated previously, ACA will not expose the ground water on the mining site. Any water <br />used during mining will be purchased through a substitute supply plan with the Division of <br />Water Resources. The concrete and Asphalt operations will use bartiers to stop any spill Of <br />fluid that may come into contact with the ground water. Specifically, the protection of <br />solvents, fuels or greases that may be used will be stored in a lined structure so none of <br />these fluids penetrate the ground. The use of concrete, impervious liners or other <br />approved liners will be used to contrd spills. <br />5. As shown on the mining plan and the reclamation plan ACA intends to mine the property in <br />phases. The timelines shown in sections D and E show the timelines. The mine and <br />reclamation maps show the acreage in each of the phases. As I stated previously ACA will <br />maintain the 4:1 slope as we are mining up to boudaries or structures. ACA feels the <br />maximum disturbance of 60 acres will be disturbed. It is our intent to reclaim the site as ft <br />progresses (as shown in our mining and reclamation time lines sect. D & E). An updated <br />reclamation bond calculation, the mining and reclamation time lines and the seed quote we <br />are basing the costs on are included. <br />
