You have indicated that your concern in
requesting that the Water Quality Control Division (WQCD) intervene to halt the
project ie the potential damage that the large volume of water proposed for
discharge to the Arkansas Aiver and Tallahassee Creek will create serious impacts
to the two waterways.
In preparing a response to your letter, I reviewed the proposal submitted
to the Division of Minerals and Geology (DMG) for the gravel mining operation and
the gravel mining and processing permit issued by this Division on February 4,
1998; mat with a representative from DMG to review the project and the water
quality impacts; consulted with the US EPA to confirm the criteria and process
for ordering an EIS; verified the need for a section 404 dredge and fill permit
from the U.S. Army Corps of Engineers, and contacted the Fremont County Planning
office regarding the County's position on and statue of the proposed project.
I also conferred with WQCD hydrologists regarding the potential water quality
impacts of the proposed project.
The DMG application indicated that there will be a discharge of the volume
you indicated to Tallahassee Creek. To ensure protection of the quality of the
water and maintenance of the etandarde in this segment of the Creek, the
discharge ie covered by a permit, issued by the Water Quality Control Division,
which specifies the limits for total suspended solids (TSS), pH, and oil and
grease, the principal constituents of concern for gravel mining and processing
operations. This permit, /COG-500325, was issued to Agile Stone Syeteme on
February 4, 1998.
The WQCD permit addressee the constituents in the discharge, ensures that
the permitted emounte will protect the classified uses of the water, and
maintains the etandarde assigned to the receiving segment. The classified uses
on this segment of Tallahassee Creek are recreation class I, aquatic life class
I (cold water), water supply and agriculture. The discharge permit limits
included in the permit, which Agile Stone Syeteme moat adhere to, ensure that
these uses will be protected.
