Letter to Judy Hinnick
Page 2
I learned from the US EPA that an Environmental Impact Statement (EIS)
applies only when n federal facility, activity or funding ie involved. For this
project, request for an EIS should be directed to the U.S. Army Corps of
Engineers (COE) who will evaluate and act on the request for a dredge and fill
permit needed for the abutments that will support the two bridges proposed at the
gravel mining and processing Bite. Our records indicate that the permit
application for the dredge and fill permit hoe not yet been filed. If you are
interested in pursuing this avenue, I suggest that you contact Anita Culp at the
COE office in Pueblo. That address and phone number are:
U.S. Army Corps of Engineers
Southern Colorado Project Office
720 North Main Street, Suite 205
Pueblo, CO 81003-3046
719/543-9459
It ie my understanding that you will need to submit youx• concerns/request
to the COE in writing, and that you will have a defined timeframe in which to do
this, once the dredge and fill permit application ie filed. Ns. Culp can notify
you of the filing date and the timelines for submitting responses. In
conjunction with the dredge and fill permit, my agency will undertake an
antidegradation analysis and certify that the quality of the water will or will
not ba adversely affected by the proposed operation.
My consultations with WQCD hydrogeologiete and with the DMG indicate that
the applicant hoe taken the steps needed to minimize the impacts to water quality
from the proposed gravel mining and processing operation. We will continue to
monitor the operation through the discharge monitoring reports that will be filed
on a scheduled basis; the DMG will address water quality considerations in the
reclamation permit that will be issued.
I am aware that the DNG will conduct a preheating conference on the Agile
Stone Syeteme permit application on Monday, March 16th, at 1:00 p.m. at the Canon
City Council Meeting Aoom located at 612 Royal Gorge Boulevard in Canon City.
This would be a convenient opportunity for you to raise your concerns to the
Mined Land Reclamation Board. I have enclosed a copy of the announcement for the
conference for your reference.
Beyond what I have outlined above, I don't know what else to recommend to
you. If you have further comments or questions, please call me at 303/692-3573.
I would also encourage you to attend the public hearing on the reclamation permit
scheduled before the Mined Land Reclamation Board at 9:00 a.m. on March 25 or 26
in Room 315, 1313 Sherman Street in Denver. Me. Glenda Williams develops the ,
- - Board''e agenda and'"will-De able to give you a time for the hearing after 14arch
20th. She can be reached at 303/866-3567.
Sincerely,
RatHtee , Watereh d Coordinator
Arkansas and Rio Grande aein
WATER QUALITY CONTROL D ISION
Enclosure
cc: Anita Culp, U.S. Army Corps of Engineers
~/Glands Williams, Division of Minerals & Geology
Phil Hegeman, Permits Unit, WQCD
Watershed File
