LOng <br />1t1t.U~L(I.r I;., =~ r I~ \, DivisionDireuor <br />//I/n'~ !/} ~.Y <br />RE: Adequacy Review, 83rd Joint Venture Resource, M-92-069 <br />Dear Mr. Tuttle: <br />The following comments address your response letter and enclosures dated <br />October 1, 1992. <br />I find all owners represented by number and by boundary except Nos. 7 (Larsen) <br />and 15 (Evans). <br />Additional tree and shrub planting information listed on the new map lists tamarix. <br />Planting this small tree or shrub along watercourses or lake shores can create <br />management problems as the tamarix is a phreatophyte that establishes itself easily <br />and rapidly. Stands can be difficult to control. The Division is requesting that <br />tamarix not be included in the tree/shrub list. Also, to ensure diversity, the Division <br />requests from the Operator a commitment that not more than 30°~ of the total <br />number of trees and shrubs be of any one species. <br />2. The Division is requiring agreements with the two homeowners on the west and <br />east ends of the permit along F Street unless the Operator makes a commitment <br />that all mining activities (including stockpiles) be no closer than 25 feet to <br />dwellings, fences, powerpoles etc. and that the pit be no closer than 200 feet to <br />any of these structures. Please also indicate how these distances will be marked in <br />the field to ensure compliance. <br />3. (a) Upon approval by Weld County, please submit a copy of the approval for a <br />25 foot setback from the right-of-way of F Street. <br />(b) Compensation agreements between the Operator and Bellweather, Colorado <br />and Southern Railroad, and the overhead utility company are required unless <br />the Division receives an engineering stability analysis that demonstrates the <br />mining activity will not adversely affect the stability of their structures. This <br />certification should include appropriate soil testing and shall consider worst <br />case scenario such as maximum highwall, pit full of water, possible hydraulic <br />pressure from outside the pit, loaded trains, etc. <br />COLORADO <br />
