<br />Mr. Gary Tuttle <br />2 <br /> <br />October 7, 1992 <br />(c) When finalized, please submit to the Division a copy of the agreement with <br />Boyd Freeman Ditch Company. Disturbance within 200 feet of this ditch <br />cannot occur until the agreement is finalized and a copy sent to the Division. <br />4. The Division recognizes that the Office of the State Engineer is the main agency <br />responsible for overseeing water rights of well owners impacted by mining <br />operations within a 600 foot perimeter from pit shoreline. Requests for agreements <br />with well owners is therefore withdrawn. Monitoring and mitigation plans are <br />discussed in No. 8. <br />5. Jim Green of the State Historical Preservation Office has reviewed your application <br />and given clearance to this operation because it lies within the Cache La Poudre <br />flood plain. <br />6. (a) Correction recorded. <br />(bl The Applicant has stated the asphalt batch plant will be located within a <br />phased plant site. Additionally, the Division is requesting a plan addressing <br />how blowdown waters will be contained, how oil unloading from trucks will <br />be handled, and how spillages will be contained. <br />7. Explanation understood. <br />8. In order to minimize any disturbances to the quality and quantity of the hydrologic <br />balance, the Division requests the following monitoring and mitigation specifics: <br />(a) Provide mapped locations of the five wells to be monitored. <br />Ib) Ground water level, temperature, and conductivity of each well should be <br />monitored quarterly and submitted with each annual report. Baseline data <br />should be taken before operations begin and continue concurrent with <br />operations. Please submit a complete monitoring plan which includes these <br />commitments. <br />(c) If recharge ponds are used in the mitigation plan, submit to the Division a <br />design and an embankment stability analysis by a professional engineer on <br />the two recharge ponds of approximately 5,000 square feet each. It is <br />understood that their excavation will be dependent on well monitoring data <br />and that projected locations are at the southeast and southwest ends of the <br />permit between the mine and the well impacted. The proximity to a dwelling <br />underlines the importance of the stability analysis for these ponds. <br />9. Data as requested in No. 8. <br />10. Copies of bond calculations will be provided at the meeting on Friday, October 9th. <br />The figure given in the previous adequacy review is the total for the operation, less <br />
