Shelton
Director
June 21, 1982
Mr. L. Otto Goemmer
Box I1165
La Veta, Colorado 81055
RE: Rocky Flat Gravel
File No. 82-129
Dear Mr. Goemmer:
Enclosed please find a copy of a letter of protest (or concern) from
an adjacent landowner, Mr. Donald R. Martin, concerning the mining
and reclamation permit for the above captioned proposed operation.
Many of his concerns either parallel those in my letter to you of
June 15th or were actually mentioned in that letter. Some of his
other points are good ones, and I ask that you respond ro them as
you do my questions.
First of all, you did not describe the existing gravel pit except to
mention it on the application form itself. I presume that all of the
old disturbed area will lie within the 7.5 acres that you plan to
permit. The location of the existing pit and its relation to future
mining should be described and shown on Che map, as well. As you know,
your responsibilir7 for reclamation of this site includes all lands
that you have disturbed since July 1, 1973, unless the material was
~ used solely by you on your ranch. In any case, a good reclamation plan
should integrate the old, existing disturbance with the new disturbance
to the extent possible.
Considering that mining has already occurred on this site, is there
still enough topsoil available to provide 6" overall disturbed areas
as is cortunitted to in your permit application? Please be advised
that you will be responsible for replacing this amount of topsoil
when reclamation is done.
