The <br />~ Mined Land Reclamation Act requires that, whenever possible, mining <br />~°c`~ ~ + ,, be concurrent with reclamation. Also, if some parts of the permit <br />' k area can be reclaimed by you and released by our Board before the <br />/ mining is over, the total amount of financial warranty may be reduced <br />by our Board. Please clarify your plans in this regard. <br />In reference to Mr. Martin's point seven, what is the situation as <br />regards water standing in the existing (and future) pit? Will this <br />Yoperation be reclaimed as a revegetated depression or a marshy, shallow <br />\ pond? Is ground water to be disturbed by this operation? Please <br />clarify this entire situation. <br />The other matters mentioned by Mr. Martin have already been mentioned <br />in my adequacy letter or in your permit application, and I have not <br />mentioned them further in this letter. Please append this letter to <br />my letter of June 15th, as an extension of my list of concerns. <br />Considering the fact that you now must answer this letter as well as <br />my previous adequacy letter before the permit application can be <br />considered adequate for Board consideration, I strongly recommend <br />that you request a continuance until the July 21-22, 1982 meeting of <br />our Boarcl. That will give us enough time resolve these questions <br />before the application goes to the Board. Unless we could resolve <br />all the concerns in both of my letters, I would have to recommend <br />that the Board deny Che application because it is not yet adequate. <br />I have also enclosed a letter of protest received just today from <br />Mr. John C. Davis. I have written him a letter explaining how his <br />concerns are eithe ro be considered by our Board or must be considered <br />at the Huerfano County level. The enclosed copy of the letter of protest <br />from Pfr.
