Long <br />Division Dvecmr <br />Listed below are additional adequacy review comments on the Wagner/Kauffman Pit #3 New <br />112 Application, Permit Number M-99-069. The Division of Minerals and Geology (Division) <br />is required to make an approval or denial decision no later than September 13, 1999, therefore, <br />your response to the following adequacy review concerns should be submitted to the Division as <br />soon as possible. <br />The applicant identified wetlands on the new Exhibits submitted to the Division. Please be <br />awaze that wetlands can not be disturbed until the Department of the Army, Corps of <br />Engineers issues a permit. Please commit in writing that no wetlands will be disturbed until <br />the Department issues the appropriate permit. <br />2. The applicant states that they have applied for a Substitute Water Supply Plan and a Well <br />Permit from the Office of the State Engineer. Please commit in writing that groundwater will <br />not be exposed until the Office of the State Engineer approves both applications. <br />3. The applicant states that wells #6 and #7 were changed in ownership to Jake Kauffman & <br />Sons. The applicant stated that a copy of the SEO ownership approval for the wells was <br />included. The Division was unable to find the SEO approval for the two wells. Please send <br />the Division a copy of the SEO approval. <br />4. The following questions aze regazding the Slope Stability Study conducted for the <br />Wagner/Kauffman Pit #3; <br />•_ Please confirm the depth, width, and distance from the face of the excavation of the de- <br />watering trench. <br />
