You <br />have determined the NOI to be incomplete based upon Regulation 2.02.2(2). You have <br />also determined that the exploration activities described in the NOI will "substantially <br />disturb" the natural land surface as defined in Regulation 1.04(127). <br />In your letter, you have requested resolution of several issues in light of the <br />incompleteness of the NOI and the "substantial disturbance" during the exploration <br />activities. A categorical response to your inquiries follows below: <br />BLM has designated Western Fuels-Colorado's exploration license application as <br />COC 69822. At this time, we are conducting an Environmental Assessment of <br />the exploration azea as per BLM's requirement. A copy of the BLM approval will <br />be provided to you as soon as it is received by us. <br />2. You have asked whether some of the drill holes might require traversing fee <br />lands and, hence, permission from the land owners. You correctly noted that Map <br />1 showed access to Hole NHTP06-78 through fee lands. Map I has been revised <br />to remove the access through the fee lands. With this change, access through fee <br />lands to all drill holes will be via public roads only and, therefore, will not <br />require access agreements. A copy of the revised Map 1 is enclosed. <br />3. I have written to Colorado Division of Wildlife for a clearance on the threatened <br />and endangered species in the exploration area. You will be notified of their <br />response as soon I receive it.
