Box 1240 Dimsinn Dimci^~ <br />Grand Junction, CO 81502 <br />RE: Adequacy Letter, Emerald Vista Estates, File No. M-94-006, Las Animas County <br />Dear Mr. Kirtland: <br />In order to satisfy the requirements of the Mined Land Reclamation Act and the Mineral <br />Rules and Regulations the below noted concerns need to be addressed, corrections made, and <br />an amended return submitted (pursuant to Rule 1.5). <br />1. Topsoil and overburden stockpiles are shown to be located around the <br />proposed disturbed area. You do not identify which is which. Topsoil and <br />overburden must be segregated. You need to identify the different stockpiles. <br />Rather than restricting their locations, all you need to do is commit to placing <br />a sign at each stockpile identifying what it is. <br />2. You do not state how much topsoil you intend to strip off and replace. This <br />needs to be included in the mining and reclamation plans. Also, if the <br />stockpiles are going to be left in place for more than one growing season the <br />sideslopes must be graded to 3:1 or less and a vegetative cover must be <br />established. <br />3. You state in the application that the excavated material will be screened. What <br />will happen to the reject fines? <br />4. Explain what you mean by "drawing stormwater to retention areas". <br />5. You state you will use topsoil berms to retain stormwater. I need a more <br />detailed discussion about this. In addition, I will need dimensions of the <br />berms, the amount of expected maximum rainfall, the amount of water you <br />expect to retain, how you calculated the size of the berms necessary to contain <br />the water, what maximum storm event you used in the analysis, and whatever <br />other data you used in your analyses. <br />
