Walther
Executive Director
Michael B. Long
Division Director
1 have completed my adequacy review of the above-named permit application, and have a few questions and
concerns which must be addressed prior to the Division's decision. The items to be addressed are listed below i^
the order of the application item or exhibit to which they pertain. I have included applicable rule reference numbers
from the Hard Rock and Meals Rules and Regulations for your use. Please respond to each item, and arrange your
responses in the same order to facilitate our review.
Application Item 9 -Location Information
I. The principal meridian you indicated here is the 6th Principal Meridian (6th P.M,), also known as the Colorado
Principal Meridian, when in fact the site is located on the grid defined by the 10th (or New Mexico) P.M. This is
probably a typographical error, since the correct principal meridian is included in the legal description in Exhibit A.
Unless you advise me otherwise, I will manually correct this application item to reflect the correct information.
Exhibit A - Leal Description and Location Mao (Rule 6.3. Il
2. The exhibit describes two claim areas, comprising a total of 15.331 acres, though the application form itself
states that the permitted area will consist of 9.84 acres. This discrepancy will be discussed below, but must also be
clarified under this exhibit.
3. The location map does not include a scale (and cannot be well approximated since there are no section lines),
does not show names of any adjoining landowners, and does not depict the site location very well. Please provide a
map which shows these features, as required.
Exhibit B -Site Description (Rule 6.3.2)
4. We are currently reviewing the water quality sampling results, and will contact you under separate cover if there
is any further information needed.
5. The location indicated on the soil map is one-half mile too far west. My estimate of the location of the mine
indicates that two more soils may occur on the permit area, referred to on the map as types "RO" and "RS." Please
provide description of these soils also, if you agree with my assessment of the site location.
Exhibit C - Minine Plan (Rule 6.3 3)
6 It is not clear how the size of the existing waste dump will not increase as underground mining proceeds. Also,
please describe surface activities which will occur during hauling and placement of waste rock and ore, such as
