Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are the additional items and information we are requesting in order to complete our <br />adequacy review on the Klement Pit, New 110(c) Application, Permit No. M-2007-076. The <br />Division of Reclamation, Mining, and Safety (Division) is required to make an approval or <br />denial decision no later than November 29, 2007, therefore, your response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. Your <br />response should include two (2) copies. Any public comments that we receive on your <br />application during the interim will be forwarded to you. <br />1. The Division has received the required notice to the affected land's owners (the <br />Klement's) from the County. However, as required by Rule 1.6.2 (1)(e)(ii), please also <br />submit the proof of notice owners of record of al[ [and surface within 200 feet of the <br />boundary of the affected lands. As stated in the application these owners of record <br />include: the Darrel E. Aldrich Trust, the Campbell Family Tmst and Donna M. Campbell, <br />Barry J. and Carolyn Gerstner, and James R. and Marla K. Hadacheck. If the applicant is <br />unable to provide signed certification of receipt of said notice, then proof of the <br />applicant's good faith attempt to provide notice is required. Attempts to deliver certified <br />mail can be obtained from the US Postal Service in lieu of signed receipt certification. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional <br />engineer, or other qualified person. The maps submitted to the Division were not signed. <br />Please resubmit signed copies of the maps. <br />Rule 6.3.1 Exhibit A- Legal Description and Location Map <br />The application (and all other information) indicates that the site is located in the east half <br />of the southeast quarter of Section 26, but the Location Map provided shows the <br />Office of Office of <br />Mined Land Reclamation Denver Grand Junction Durango Active and InaQive Mines <br />
