Cottony <br />Division Director <br />Natural Resource Trustee <br />RE: Anderson Pit,, Flle No. M-2005-021 New 112c Application Preliminary Adequacy Review~~' <br />Dear Mr. Gibson: <br />DMG has completed the preliminary adequacy review of your application fora 112c permit for the Anderson <br />Pit site. The application cannot be approved until the following issues are adequately addressed. Please <br />submit a response to the following issues as soon as possible, but no later than July 27, 2005 so the decision <br />due date set for August 1, 2005 can be met. If you cannot respond by July 27, 2005 please submit a written <br />request for extension of the decision date. If your response, or an extension request, are not received by July <br />27, 2D05 this application may be denied. <br />ADEQUACY ISSUES <br />Exhibit C -Pre-mining and Mining Plan Maps <br />1. Please submit, on map C-1, the information required by Rule 8.4.3 (g) Specifically for the county <br />roads, fhe water line and phone lines, and co-owned fence sections. <br />2. Please specify, on map C-1, who owns the parcel located off the southeast corner of the <br />proposed permit area. <br />3. Photographs in Exhibit J indicate they are showing a road that bisects the Anderson property east <br />to west. These photos show overhead power line poles along that road. This power line does <br />not appear on the maps and is not addressed in the permit. Please correct this discrepancy and <br />perform any notice requirements if a new structure owner is identified. <br />4. It is apparent that the access road and discharge ditch construction/improvements are due to the <br />mine proposal, and are therefore must be included in the permit area..Stability and sediment <br />control for these features will be required for the life of the permit. An amendment to this <br />application must be submitted to address incorporation of these proposed features into the permit <br />area. All review timeframes will start anew when the application amendment is submitted. All <br />notice requirements must be redone per rule 1'.8.8. It appears that the addition of these areas in <br />the permit area will result in more adjacent landowners within 200 feet that will need to be <br />notified. <br />5. Map C-1 appears to show some grain bins or similar feature within 200 feet of the affected area. <br />These and any other structures within 200 feet of the permit boundary, as revised by the <br />requirements of item no. 4 above must be identified on the map and their ownership specified. <br />Office of Office of Colorado <br />
