Before a decision can be made on your application, <br />the following items need clarification. Please provide a response to each item prior to <br />July 13, 2004. If you are unable to fully respond to this letter, please contact me <br />requesting continuance of consideration to a later date. Please be advised that your <br />application maybe deemed inadequate, and denied on July 20, 2004 unless the following <br />adequacy review items are addressed to the satisfacflon of the Division. <br />Exhibit C- Pre-Mining and Mining Plan Maps of Affected Lands <br />1. Section 6.4.3 (c) of the Construction Materials Rules requires that the total of the <br />azea to be involved in the operation; including the azea of affected lands be shown <br />on an Exhibit C Map. During the Pre-Operation inspection the Division was <br />informed that a portion of the access road will be upgraded. Section 1.1 (3) states <br />that, if a road is existing but will be significantly upgraded, it must be included in <br />the proposed permit affected lands. Please change the Exhibit C Map to include <br />that portion of the access road that will be significantly upgraded or, state that the <br />existing road will not be significantly upgraded. <br />Exhibit D- Mining Plan <br />2. Leone Sand and Gravel has committed "to placing topsoil and overbuuden <br />stockpiles along the entire low edge of all the mining phases as a first step of <br />mining operations. The berms and pits created will control erosion and <br />sedimentation."
