The application for a Reclamation Pem3it for this operation was deemed adequate for
technical review on Apri121, 2004. Before a decision can be made on your application,
the following items need clarification. Please provide a response to each item prior to
July 13, 2004. If you are unable to fully respond to this letter, please contact me
requesting continuance of consideration to a later date. Please be advised that your
application maybe deemed inadequate, and denied on July 20, 2004 unless the following
adequacy review items are addressed to the satisfacflon of the Division.
Exhibit C- Pre-Mining and Mining Plan Maps of Affected Lands
1. Section 6.4.3 (c) of the Construction Materials Rules requires that the total of the
azea to be involved in the operation; including the azea of affected lands be shown
on an Exhibit C Map. During the Pre-Operation inspection the Division was
informed that a portion of the access road will be upgraded. Section 1.1 (3) states
that, if a road is existing but will be significantly upgraded, it must be included in
the proposed permit affected lands. Please change the Exhibit C Map to include
that portion of the access road that will be significantly upgraded or, state that the
existing road will not be significantly upgraded.
Exhibit D- Mining Plan
2. Leone Sand and Gravel has committed "to placing topsoil and overbuuden
stockpiles along the entire low edge of all the mining phases as a first step of
mining operations. The berms and pits created will control erosion and
sedimentation." Please describe the dimensions of the topsoil and overburden
