berm, and the pits. The berms and pits must be constructed to act as a sediment
control facility to keep sediment from entering the drainage that bisects the permit
area. Also, show the locations of the separately stockpiled topsoil and other
overburden materials on an Exhibit C Map.
3. Please provide construction plans for the containment facility for petroleum
product spills, including the liner.
Exhibit E- Reclamation Plan
4. Your reclamation plan at 6.4.5 (1) states ".......only the appropriate grasses
selected by the NRCS will be used." Your application has two reclamation seed
mixes recommended by the SCS/NRCS; one included in an Oct.12, 19791etter
and recommendation from Lee Neve of the Soil Conservation Services (now the
NRCS) and another in a CO-ECS-S Form by NRCS Planner Tony Arnold dated
Sept. 10, 2003. You have referred to both in your plan. The Division assumes
that the CO-ECS-S form includes the application's seed mix and other
reclamation plans since it is the newer document. Please confirm that this form is
the basis of the reclamation plan and state which recommendations on the form
will be implemented. Will any portion of the 1979 recommendations remain as
part of this application? If so, please state what portions will remain.
Exhibit L-Reclamation Costs
5. The Division has reviewed your reclamation costs in conjunction with your
mining and reclamation plans. After making some necessary assumptions, the
Division has estimated that reclamation costs would be $30,218.00. Based on this
cost estimate, the Division will require a Financial Warranty amount of
$30,200.00 unless significant changes to the reclamation plan are made prior to
permit approval.
Exhibit S-Permanent Man-Made Structures
6. The information you provided on the first page of this exhibit only identifies
fences asman-made structures within 200 feet of the affected land. However, it is
obvious from other documents in the exhibit that a double pipeline belonging to
Colorado Interstate Gas crosses the proposed permit azea. The gas company has
reviewed your mining plan, and, in a letter dated May 14, 2004, listed their
requirements regarding the pipelines and the proposed mining operation. Please
have Leone Sand and Gravel sign the letter agreeing to all of the requirements.
Have the agreement notarized and send a copy for inclusion in this exhibit.
