The Division is required to make an approval <br />or denial decision no later than August 28, 1997, therefore, your <br />response to the following adequacy review concerns should be <br />submitted to the Division as soon as possible. If you feel more <br />time is needed to complete your reply, an extension to the decision <br />date can be granted by the Division. This will be done upon <br />receipt of a written waiver of your right to a decision by August <br />28, 1997 and request for additional time. This must be received no <br />later than August 27, 1997. <br />Please clarify who the immediately adjacent surface owners are <br />as required in Rule 6.3.1(1). Do they include the nine <br />landowners to the west listed on Exhibit E? Is William Porter <br />the adjacent landowner to the north, east and south? <br />Rule 6.3.2(a) requires that a description of the vegetation <br />and soil characteristics in the area be provided in Exhibit B. <br />The soil description has been provided, however, the <br />vegetation has not been adequately described. The local Soil <br />Conservation District office in Fort Collins can help you with <br />this. <br />The mining plan states that there is an average of 1 inch of <br />topsoil on the permit area. During our site visit on August <br />e, 1997, we found pockets of topsoil 3 inches thick or greater <br />between outcrops of sandstone bedrock. It appeared that the <br />topsoil thickness increases toward the east along the lower <br />parts of the hogback. Due to the thin topsoil layer and the <br />difficulty you will have in removing it, please state your <br />
