M-2007-00 , A equacy Review <br />Listed below are the additional items and information we requested in order to complete our <br />adequacy review on the Kiowa Clay Mine, New 112(c) Application, Permit No. M-2007-009. <br />The Division of Reclamation, Mining, and Safety (Division) is required to make an approval or <br />denial decision no later than May 27, 2007, therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. Your response should <br />include two (2) copies. Any public comments that we receive on your application during the <br />interim will be forwarded to you. <br />As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public <br />notice circulated in the local newspaper, all owners of record of surface and mineral <br />lands, easement holders, and owners of record of surface lands that are within 200 feet of <br />the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />2. The application states 400 permitted acres, the introduction states 72 acres to be disturbed <br />by mining and an additional 20 acres for various staging activities, but the mining plan <br />under Exhibit D describes 2 phases of mining (the first phase to include 10 acres). <br />Finally, the reclamation costs provided in Exhibit L are based on 80 acres of disturbance. <br />Please clarify the maximum disturbed acreage planned for the entire site over the life of <br />the mine, and commit to a maximum acreage to be disturbed at any given point in time if <br />these two acreages vary. <br />3. Please provide the source of the water to be used for dust suppression. <br />4.
